Terms of Use

Any use of the Game and/or its services in violation of the Terms of Use will be regarded as an infringement of Something2Play's copyrights.  You agree that you will not, under any circumstances:

  • Use cheats, automation software, hacks, mods or any other unauthorized third-party software designed to disrupt or modify Survival Strike the ("Game"), or its servers and associated services.
  • Use the Game for commercial purposes in a cyber cafe, event or LAN gaming party without written authorized permission from Something2Play Limited.
  • Use a modified version of the Game client that has not been authorized by Something2Play Limited.
  • Launder in-game currency, items or resources for sale outside of the game without Something2Play's authorization, or take payment in exchange for promoting other players levels through rank progression.
  • Host or duplicate our Game or associated services without a commercial licence to do so.
  • Emulate, monitor or redirect any communication protocols used by Survival Strike in any way, for any purpose.
  • You may not copy, reproduce, sell or sub-licence, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use the Survival Strike Game, SurvivalStrike.com website or associated website(s) content or services that is owned by Something2Play Limited in any way.
  • You also agree not to adapt, alter or create derivative works from any of Something2Play Limited games, websites, artwork, whether owned or licenced.
  • Any use of website content requires the prior written permission of Something2Play Limited.  If you wish to use content for use on your site outside of our media kits you must obtain permission from us first.

You may, under the terms of use:

  • Use the Game for your own non-commercial entertainment purposes by accessing it with a PC / MAC using an authorized , unmodified Game client.
  • You may download our media kits which will provide you with licenced versions of screenshots and logos for advertising and reviewing Survival Strike and may be used without permission however you will be requested to notify us by email as to where the advertisement or review has been placed.

Before you can use the Game and its associated services you must (i) agree to the Terms of Use and Privacy Policy. (ii) Purchased a legal copy of the Game through our website or authorized distributor / retailer that will be listed on our website in order to be legally licensed to use our software. (iii) Register an account on our website in order to gain access to our online services.

Intellectual Property

All names, images, logos identifying Survival Strike ("Game"), Artwork content, SurvivalStrike.com website, Something2Play Limited or third parties and their products, content, artwork, software and services are subject to copyright, design rights and trade marks of Something2Play Limited or their respective owners.

Account Creation

Accounts registered must be registered with a valid personal email address that you access regularly so that emails can be sent to you by our staff.  Accounts registered with temporary email addresses will be closed if a member of staff cannot get in contact with you.  All email addresses must be validated for sercurity purposes.  Something2Play Limited reserved the right to close accounts if any user is seen to be using software or proxy services to hide the use of multiple accounts, or disrupt any of our services in any way.  Accounts are used for access to the Survival Strike game and its associated website services such as account management and forums. To open an account at Survival Strike and purchase the Game you must be 18 years of age or older.  This age restriction is subject to the mature content nature of the game and may reduce depending on the overall rating on full release.

Account Usernames must not contain:

  • Offensive, vulgar or inappropriate words in full, in short or abreviated.
  • Branded or non branded Company names.

Any Account Username that contain the above will be suspended or removed from the system until a member of staff can assign you with a random name that cannot be changed.

Survival Strike Forums

You agree to use the SurvivalStrike.com forums in accordance with the following forum rules:

You may not:

  • Submit or share any defamatory, racially offensive, unlawful, harrassing, abusive, offensive, obscene, inappropriate, threatening or illegal content/material of any nature in the SurvivalStrike.com forums
  • Submit material/content with the intention of causing trouble.
  • Advertise or promote commercial websites, games or services - Contact our Marketing department if you have a requirement.
  • Spam the forums with multiple, or off-topic content.

If you fail to abide by these Forum Rules then we will first make you aware of these rules and remove or modify any posts at our own discression and may result in action being taken against your account(s) if you continue to break these rules, dependant on the severity of the post.  We have a fair, but firm moderation procedure.

Player Profiles

Player Profiles are stored locally on your machine.  You are permitted to have up to 5 player profiles at any given time on one machine, comprising of single and/or multi-player.  Currently player profiles are specific to the machine that Survival Strike has been installed on.  This may change in the future so that you can play Survival Strike from any machine by downloading your multi-player profiles to that machine first.  Only one multi-player profile will be permitted to be used online at any given time.   Your online name is then reserved to your user account providing that the name is available.  Once your online players name is reserved to your user account it cannot be sold, transferred or renamed.  Once a player profile has been deleted, you cannot create one with the same name as it will no longer be available.

Online Players Names for Multi-Player use must not contain:

  • Offensive, vulgar or inappropriate words in full, in short or abreviated.
  • Branded or non branded Company names.

Any Players Names that contain the above will be banned from accessing any of the servers.  Your player profile will then need to be deleted and re-created.

Safety and Security

We advise that you never give out any information relating to your account, including your name, postal address or telephone number.  Our staff at Something2Play Limited or under the SurvivalStrike.com domain will never ask for your password to your account, so keep it in a safe place and never give it out.  In the event that you cannot access your account we will generate a new password for you and send it to the registered email address.  If you no longer have access to your email address we will ask you a set of security questions that are associated to your account which only you may know.

Refund Policy

All sales are final, unless:

  • You are having difficulty installing or launching the game, by notifying us in an email within 48 hours of purchase. We will then provide you with a crib sheet to help you with the installation.  If you are still having problems with the installation after 10 days we will then provide you with a refund within the next 20 working days.  Any reserved player names and online profiles will then be disabled.
  • We have billed you incorrectly for the item(s) you have purchased from our store.
  • Duplicate purchases.

Refunds will only be made by the means that they were originally paid for.  All purchases made through official distributors/retailers of Survival Strike are non-refundable, you will need to contact them directly where their own refund terms and conditions will apply.
 

Third Party Advertising
Survival Strike may include in-game advertising, sponsor logos or product placements which are downloaded and displayed within the game or during the game level and mission loading process.  During this procedure Something2Play may collect information relating to which advert was shown, including standard connection information.  Something2Play will use this information to provide statistics based on the advertisement, with no connection information being provided to identify you to third parties.   For additional information, please see our privacy statement.  All trademarks and copyrighted marterial contained in the in-game advertising, sponsor logos or product placements remain the property of their respective owners.

Technology used
Survival Strike has been developed on the Torque 3D games engine by Garage Games.  
Game Rankings for each game server are produced by our own Game Ranking System software that is developed in-house at Something2Play Limited.
All in-house developed software and systems remain the copyright of Something2Play Limited.
All other technologies and artwork used are in accordance with their licence agreements and remain the copyright of their respective owners.

General

1. Terms of Use may be updated or revised by Something2Play at any time and published on the Survival Strike website without notice.
2. Something2Play Limited may assign terms of use, in whole or in part, to any person or entity at any time with or without your consent.  
3. If any part of this terms of use agreement is determined to be invalid or unenforceable, then that portion shall be severed, and the remainder of the terms of use agreement shall be given full force and effect.
4. Whilst we do our best to moderate our website and forums you may be exposed to content that you may find offensive, indecent, objectionable, inaccurate.  You bear all risks assicated with using that content.  We reserve the right to remove any content that may, in our sole descretion, violate these Terms Of Use.  Please contact us directly if any content or material on our forums is inappropriate and we will take action accordingly.
5. Something2Play Limited shall not be liable for any delay or failure to perform or provide its services, resulting from causes that are outside the reasonable control of Something2Play Limited due to unforeseen circumstances or causes beyond Something2Play's control.

Disclaimers

While Something2Play Limited works hard to ensure that Survival Strike, its website and services are functioning correctly and is accurate as possible, this may not always be achievable and therefore the following disclaimer applies:

  • Something2Play does not guarantee or represent that the content and/or facilities available or accessible via the official websites will always be accurate, complete, current or uninterrupted.
  • Something2Play provides a service on an "AS IS" and "AS AVAILABLE" basis for your use, without warranties of any kind, express or implied.
  • Something2Play does not warrant that you will be able to access or use the services at the times or locations of your choosing, or that the service will be uninterrupted or error free; that the defects will be corrected; or that the game client or the online services are free of ciruses or other harmful components.

Limitation of Liability

  • Something2Play is not responsible for damages arising out of your use of the game, services or your inability to use the game or services.  In no case shall Something2Play be liable for any special, incidental, indirect, punitive or consequential damages arising from your use of the game, services or game client.  In no case shall the liability of Something2Play exceed the amount that you paid to us prior to the time your cause of action arose.
  • You acknowledge and agree that your sole and exclusive remedy for any dispute with Something2Play is to stop using the game and services, and to cancel all accounts with associated profiles that are registered to you.
  • You agree to indemnify, defend and hold Something2Play harmless from any claim, demand, damages, or other losses, including reasonable attorneys/solicitors fees, asserted by any third-party resulting from or arising out of your use of the services, game or any breach by you from the Terms of Use, the In-Game Rules or any Game EULA.
